Our firm frequently assists employers in bringing foreign workers to the U.S. on both temporary visas (including E-1/E-2, H-1B, J-1, L-1, O-1, and TN) and permanently through employment-based immigrant visa preference categories (EB-1, EB-2, EB-3). In addition to standard worker visas, we are also able to assist clients in applying for the permanent EB-5 business investor visa for those interested in investing in a U.S. commercial enterprise.
Form I-9 Employer Compliance
Employers who do not comply with the I-9 requirements may be subject to civil penalties ranging from $110 to $1100 per violation. For knowingly hiring and continuing to employ an unauthorized worker, penalties range from $375 to $16,000 per violation. “Knowing hire” and “continuing to employ” violations can also result in criminal prosecution and debarment from participation in some federal programs.

Some U.S. employers who wish to hire foreign works, either temporarily or permanently, will need to go through the labor certification process with the Department of Labor (DOL). The labor certification process verifies that there are no qualified and willing U.S. workers available to fill the position being offered by the U.S. employer at the prevailing wage. The process must also demonstrate that hiring a foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

Deferred Action for Childhood Arrivals
In June 2012, the Department of Homeland Security issued a memorandum permitting certain individuals who came to the United States as children to apply for consideration of deferred action and employment authorization. GO Legal Advisors assists clients in assessing their eligibility for Deferred Action for Childhood Arrivals (DACA) and completing a comprehensive application packet that fulfills each of the required guidelines. Following a DACA approval, we walk our clients’ through the process of correcting and/or applying for a Social Security Number, applying for a Driver’s License, and making any necessary changes to their wage and tax documents.
