PRACTICE AREAS

Expertise and results in a variety of practice areas.

Work Visas

Our firm frequently assists employers in bringing foreign workers to the U.S. on both temporary visas (including E-1/E-2, H-1B, J-1, L-1, O-1, and TN) and permanently through employment-based immigrant visa preference categories (EB-1, EB-2, EB-3). We are able to provide complex analyses of each individual situation and determine a strategy that will best fit the client’s needs. In addition to standard worker visas, we are also able to assist clients in applying for the permanent EB-5 business investor visa for those interested in investing in a U.S. commercial enterprise.

Form I-9 Employer Compliance

Employers who do not comply with the I-9 requirements may be subject to civil penalties ranging from $110 to $1100 per violation. For knowingly hiring and continuing to employ an unauthorized worker, penalties range from $375 to $16,000 per violation. “Knowing hire” and “continuing to employ” violations can also result in criminal prosecution and debarment from participation in some federal programs.

GO Legal Advisors can help your business ensure it is in full compliance with the I-9 regulations by conducting or facilitating comprehensive self-audits of existing I-9 forms; assisting with proper correction of I-9 form errors; creating a custom-tailored I-9 Compliance Plan for your company, including potential enrollment in the E-Verify program; and representing your business if Immigration and Customs Enforcement (ICE) has issued a Notice of Inspection or has proposed a fine.

Labor Certification

Some U.S. employers who wish to hire foreign works, either temporarily or permanently, will need to go through the labor certification process with the Department of Labor (DOL). The labor certification process verifies that there are no qualified and willing U.S. workers available to fill the position being offered by the U.S. employer at the prevailing wage. The process must also demonstrate that hiring a foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

GO Legal Advisors has extensive expertise in labor certification and guides its clients seamlessly through the process. We enjoy working closely with our clients and custom-tailoring the process to fit our clients’ needs and the unique nature of their jobs.

Deferred Action for Childhood Arrivals

In June 2012, the Department of Homeland Security issued a memorandum permitting certain individuals who came to the United States as children to apply for consideration of deferred action and employment authorization. GO Legal Advisors assists clients in assessing their eligibility for Deferred Action for Childhood Arrivals (DACA) and completing a comprehensive application packet that fulfills each of the required guidelines.
